1. Scope of Services & Location Requirements
All photography sessions will take place on-location at the setting of the Client’s choice. I will provide all
necessary professional cameras, standard backdrops, and lighting equipment required to execute the session
successfully.
• Location Notification Policy: The Client must specify the exact location venue upon booking. If the session
venue or location is changed, the Client is required to notify me at least four (6) hours prior to the
scheduled session start time. If the location is changed and I am not notified with at least 6 hours' notice of
the new location details, the session will be immediately forfeited, the session will not be shot, and all
monies paid to date will be kept by the Photographer.
2. Fees, Retainer, & Payment Schedule
• Total Service Fee: The total cost for the selected photography package is $___________________.
• Non-Refundable Retainer: A 50% down payment (deposit) of $___________________ is required upon
signing this contract to secure and lock in your session date. This retainer is strictly non-refundable, as it
reserves time that prevents me from booking other clients.
• Remaining Balance: The final 50% balance is due exactly ___________ days prior to the session or event
start date.
• Payment Methods: To streamline booking and ensure secure processing, I exclusively accept digital
payments (such as Zelle, Venmo, credit/debit card invoices, or bank transfers).
3. Deliverables & Editing Policy
• Professional Editing Only: I will only deliver professionally edited, high-resolution final images that match
the creative standards of my portfolio. Under no circumstances will unedited RAW or unretouched photos be
released to the Client.
• Image Quantity: The final number of delivered media files will strictly correspond to the parameters of the
specific service package selected by the Client.
• Standard Turnaround Time: For all standard portrait and lifestyle sessions, final edited files will be
delivered within one week (7 days) of the project start date.
• Wedding Turnaround Time: Due to the higher volume of imagery requiring fine curation, final edited files for
all wedding packages will be delivered within 14 days of the event date.
• Digital Archiving Window: I will maintain and archive your final edited digital images in an online gallery for
30 days following delivery. The Client is entirely responsible for downloading, backing up, and permanently
storing their files within this window. After 30 days, I am not liable for unretrieved, lost, or deleted files.
4. Client Delay & Timing Boundaries
The photography session will begin strictly at the scheduled start time. If the Client arrives late to a session, that
lost time is deducted directly from their total session duration. If an event or wedding timeline runs behind
schedule due to client or guest delays, I am not obligated to stay past the contracted end time unless an
overtime rate is explicitly agreed upon and paid on-site.
5. Client Input & Cooperation
I welcome client input and collaboration regarding key family members, important guests, or requested
highlights. The Client is encouraged to provide a shot list or brief outlining these priorities after the retainer is
paid. While I will make every effort to highlight these specific individuals and moments, I cannot guarantee any
unscripted or spontaneous shots.
6. Intellectual Property & Model Release (ELVIS Act Compliant)
I retain full copyright ownership of all captured media files. The Client is granted a non-commercial license to
download, print, and share final edited images for personal use.
By signing this agreement, the Client grants me the absolute, irrevocable, and unrestricted right to use, publish,
and distribute the images for portfolio display, marketing, advertising, and corporate business promotion. This
explicitly covers my website, Facebook business page, and Instagram portfolio handle
(@tammybrewerphotography). The Client waives any right to inspect or approve finished marketing items or
claim financial compensation/royalties.
7. Inclement Weather & Rescheduling Policy
If an outdoor session cannot safely take place due to severe, inclement weather, the Client may reschedule to
an open date at no additional cost, and the 50% retainer will automatically transfer to the new date. However, if
the Client requests a reschedule for personal reasons, they must notify me at least 48 hours prior to the shoot,
or a rescheduling fee may apply.
8. Equipment Malfunction & Limitation of Liability
In the event of unexpected technical errors beyond my control—including but not limited to hard drive failure,
camera crashes, or corrupted memory cards—my liability is strictly capped at a full refund of all monies paid
by the Client. By signing this agreement, the Client acknowledges that this refund is the sole and exclusive
remedy available, and I cannot be held liable for any further financial damages, loss of data, or emotional
distress.
9. Automotive Booking Rules & Logistics
• Vehicle Preparation: To ensure the highest quality results, all vehicles must arrive on-location fully washed, detailed, and prepped for the camera. The photographer is not responsible for editing out heavy road grime, dust, streaks, or clutter left inside the cab.
• Retainer & Digital Terms: All automotive bookings require a 50% non-refundable down payment at the time of reservation to secure your calendar slot. In alignment with our site policies, payments are accepted exclusively through secure digital channels (Zelle, Venmo, or card invoice).
• Location Changes & Weather: Location details must be locked in upon booking. Any changes to your chosen setting require a minimum of 6 hours' advance notice to avoid session forfeiture. If severe weather prevents a safe outdoor shoot, your retainer will automatically roll over to a cleared rescheduling date at no extra charge.
